It sounds like he fits the bill. I also went through physical changes... though, Cubia altered my personality with it. I guess he didn't bother with Hien.
We don't know how to stop their transformation when someone's locked into becoming a Phase yet. Are you really okay with waiting to see what happens with him?
Data draining Cubia sounds interesting, though. I wouldn't be surprised if he has some protection against it, but...
That was only when I locked myself away. I'd have been vulnerable if I left that Area, which is why I didn't. It's why Fandaniel was so reluctant to meet me, too. If Oria had killed me the first time he noticed something off instead of using his false death skill, that might as well have been that.
Until their transformation completes, they can be killed. Unless they're wreathed by Cubia's protection, they can be killed.
( But Sinclair's sentimental... A mercykill for him is the last option, and for Mithrun, it's the first. )

( He's gonna be mostly asleep in the infirmary (injuries: thousands and thousands of small incisions across his body, and run through with some kind of broad blade(?)), hence his ominous lack of response... but he can definitely be pestered whenever he's awake, if desired. Thankfully, he's being well taken care of (also, strapped down). )

as long as they look the same as I've known them...it's hard to justify pulling the trigger. I imagine a lot of people feel the same way.
